Jakarta – Amrick, a resident of North Sumatra, has been named a suspect in a case of alleged embezzlement and fraud in the sale and purchase of a plot of land by investigators from the North Sumatra Regional Police (Poldasu).
This stipulation from a legal perspective is considered strange, awkward, and not objective. The reason is that Amrick’s designation as a suspect is not in sync with the legal evidence of the disputed land certificate.
The disputed land title de facto belonged to Amrick. Meanwhile, de jure, the name listed on the land title certificate is Selly Singgih, Amrick’s older sister.
“This is a case of criminalization carried out by unscrupulous land mafia who are strongly suspected of flirting with investigators at Poldasu,” said Amrick’s attorney, Erdi Surbakti at a journalists’ meeting in the Kebayoran Baru area, South Jakarta, Thursday (8/12).
“How is it possible that the owner of a land certificate that is legally absolute is even made a suspect over his land. The land certificate already belongs to Amrick and the SHM of the land is already in the name of Selly Singgih, Amrick’s sister,” he continued.
Erdi explained, this case started with Bijaksana Ginting’s offer to sell a plot of land near the official residence of the Governor of North Sumatra. At that time, Bijaksana Ginting claimed to be the holder of the power of attorney from the land owner named Tengku Syed Ali Mahdar.
“The land sale and purchase process was carried out in 2009. But the buying and selling process never ended. Even the deed of sale and purchase was never shown,” said Erdi.
Because the purchase process was never completed and also based on the document in the “Grand Sultan” letter it was explained that the rightful owner was not Bijaksana Ginting, finally in 2011 the buyers, namely Amrick and his sister, Selly Singgih, immediately met the rightful owner, namely Tengku Syed Ali Mahdar . The meeting was held through Zulkarnaen Purba as an intermediary.
“During that process, the power of attorney given to Wise Ginting was revoked. And the buying and selling process has been running smoothly,” Erdi explained.
In 2016, Erdi continued, his party reported Bijaksana Ginting to the Medan Police for fraud. The reporting was done because Wise Ginting had received the receipt money and was given the power of attorney to process the letters but it was never completed.
“Because he didn’t like being policed and was dealing with criminal law, in 2021 Wise Ginting took tricky revenge by policing Amrick back to the Poldasu using data from the land sale and purchase deed between Amrick and Tengku Syed Ali Mahdar,” explained Erdi.
“In his report he also said that Amrick had not paid him the remaining Rp6 billion in land purchases. Who is he? The owner of the land object,” Erdi continued.
He emphasized that, reflecting on the chronology of the incident, the investigators should not have processed Bijaksana Ginting’s report with the reporter Amrick. Moreover, there was not a single material loss that was borne by the complainant.
“For all the oddities that have befallen our client, we respectfully request serious and prompt attention from the Kapolri, General Pol Listyo Sigit Prabowo and Karo Wasidik, Brigadier General Iwan Kurniawan, to improve the handling of this inaccurate case.
“We have also sent letters twice to the National Police Headquarters to get the full attention of the Kapolri and his staff to take over this case. Because there is a strong suspicion that this case has become bankroll from the land mafia and investigators at Poldasu,” he said hopefully.
“If the attention we expect from the Kapolri and staff does not get or it takes a long time to be given, we will liven up and expand this case by making a report to Kompolnas and Komnas HAM so that the process can be stopped,” he continued. bembo
