Polda Metro will Specially Hold Hit-and-Run Cases on the Cakung Toll Road

Jakarta – The Directorate of Traffic (Ditlantas) Polda Metro Jaya plans to roll back the case specifically to determine legal certainty for OD, the hit-and-run perpetrator on the Cakung-Kelapa Gading Toll Road, East Jakarta.

This special case title will also involve the Ditreskrimum to reconstruct the article, whether OD can be charged with Article 338 concerning premeditated murder or not.

“We are currently exploring whether OD, the perpetrator of the hit-and-run on the Cakung-Kelapa Gading Toll Road, East Jakarta, can be charged with Article 338 of the Criminal Code concerning the murder or not of a motorbike rider with the initials MBP,” said Deputy Director of Polda Metro Jaya, AKBP Doni Hermawan at the Presisi Field of the Polda Ditlantas Metro Jaya, Saturday, (17/6) yesterday.

Doni continued, at the beginning of the investigation process, this incident was handled by an article related to a traffic accident.

However, based on the investigation, examination of witnesses, and evidence, the police found that there was an alleged intention.

“But we see that there is potential for the element to kill lives. We can see that the perpetrators deliberately crashed it and already knew the consequences,” Doni said.

“We will function Article 338 of the Criminal Code. In the near future (the case) can be transferred (to Polda Metro Jaya),” he added.

OD himself has been detained by the police. Doni confirmed that the investigation was still ongoing.

Currently the police have examined a number of witnesses, including OD’s mother who was in the car when the incident took place.

For your information, MBP was killed by a car driver with the initials OD, in Cakung, East Jakarta on Wednesday, (14/6) morning last week.

Prior to the accident, the police said that there had been an altercation between OD and MBP on Jalan Raya Bekasi, near the entrance to the Cakung-Kelapa Gading toll road.

“When we arrived at Cakung, there was a small incident (knocked on) when (the car) overtook the victim’s motorbike,” said Head of East Jakarta Traffic Unit Laka, Iptu Darwis Yunarta, Thursday, (15/6) last week.

After the collision, they pulled over and each got out of their vehicle. An argument had occurred even though the OD mother immediately handled it. After that, OD and his mother immediately got back into the car.

However, the problem didn’t stop there. According to OD’s confession, MBP damaged the right mirror of his car, then immediately ran away.

Not accepting, OD chases MBP. He intends to stop the victim.

“However, apparently something else happened, causing the victim (to be hit) to be injured, and died while undergoing treatment at the hospital,” Darwis explained.

In the CCTV camera footage, the victim can be seen being dragged several meters after being hit, then run over by the perpetrator’s car.

The victim immediately lay on the road before being taken to the hospital. However, MBP’s life was not spared.

For his actions, OD was charged with Article 311 Paragraph 5 Juncto Article 310 Paragraph 4 Juncto Article 312 Law Number 22 of 2009 concerning Road Traffic and Transportation. The offender faces a maximum prison sentence of 12 years. Bembo
