Jakarta – An advocate filed a lawsuit so that the validity period of a driving license or SIM was changed from five years to life. Director of Registration and Identification (Dirregident) Korlantas Polri, Brigadier General Pol Yusri Yunus.
He explained why the SIM validity period is only once every five years as stipulated in Police Regulation (Perpol) Number 5 of 2021.
“We have arranged for a driver’s license every five years by obtaining the first requirement that you must have a health certificate from a doctor, have a certificate from a psychologist,” said Yusri Yunus, Friday, (12/5).
According to him, documents such as a health certificate are mandatory as a condition for extending a driver’s license because they involve the condition of the driver.
“Why do you have to be healthy? Because people driving motorized vehicles have a very high level of danger on the road,” he continued.
The former Head of Public Relations of Polda Metro Jaya explained that the reason a driver’s license cannot be valid for life is because every year a person’s physical and mental health condition can change.
“Why do we do it like that, there are still considerations. Humans don’t say that they are whole forever, so their health and psychology are.”
“So we need to test his health again and also how his psyche is,” explained Brigadier General Pol Yusri.
Previously, an advocate named Arifin Purwanto submitted a judicial review or judicial review of Law No. 22 of 2009 Article 85 Paragraph 2 which states, a driver’s license is valid for 5 years and can be extended.
Arifin wants the SIM validity period to be made for life. He feels disadvantaged if he has to extend his SIM after the validity period expires.
According to him there is no legal certainty if it is late (extended) then it must start from new and be processed.
“Here there is no legal certainty and if it’s too late, everything has to start from anew and has to be processed. Of course, it’s inversely proportional to the KTP. So if the KTP is printed immediately,” Arifin said as quoted from the MK RI website, Friday, (12/5).
In this case which was registered with Number 43/PUU-XXI/2023, Arifin also said, the complaint he experienced was that when the STNKB and TNKB were replaced, it often caused trouble because the vehicle had to be presented at the SAMSAT office.
Arifin gave an example, if the motorcycle owned by the applicant is in Surabaya, then the motorbike must be brought to Madiun if you want to extend your STNKB and TNKB according to the address listed.
“Where the legal basis for this matter is unclear, which means it is contrary to Article 28D Paragraph (1) of the 1945 Constitution,” said Arifin.
“If the STNKB and TNKB were valid forever like before Indonesia’s independence until 1984, then there was no need to bother bringing the motorcycle from Madiun to Surabaya,” he continued.
Arifin also suggested that STNKB and TNKB be valid forever to prevent falsification and waste of money when extending STNKB and TNKB. Bembo
