Bakamla RI Arrests 3 Ships Loading Illegal Nickel in Southeast Sulawesi

One of the ships carrying illegal nickel cargo was successfully seized by Bakamla RI.

North Kolaka – Bakamla RI through elements of KN Kuda Laut-403 succeeded in seizing 3 Indonesian-flagged ships containing illegal nickel ore in Mosiku Village, Batu Putih, North Kolaka, Southeast Sulawesi Province, Tuesday, (14/11).

The three ships that have been inspected and secured by KN Kuda Laut-403 include TB Trinity 302/TK Pacific 302 which was carrying ±10,507,560 WMT of nickel ore. The ship was loading at Masselle Jetty without permission and not in accordance with the Sailing Approval Letter (SPB). The arrest was successfully carried out on Saturday, (11/11), and he was transferred to the North Kolaka Police the following day to undergo further legal proceedings.

The next ship that was secured was TB. MDM Batola/TK. MDM 04 with a cargo of ±12,333,963 MT of nickel ore which was also captured last Saturday, (11/11), and TB. Merdeka 2002/TK. Dirgahayu 3102, which was carrying a nickel ore cargo of ±8,500,570 WMT, was captured on Monday, (13/11). These two ships are suspected of loading at the Mandes Jetty without permission and not complying with the SPB.

As a result of an investigation by the Indonesian Bakamla Legal Enforcement Unit led by Bakamla Captain Arie Trifantoro, the three ships were found to have violated Law Number 17 of 2008 concerning Shipping and Law Number 3 of 2020 concerning Amendments to Law Number 4 of 2009 concerning Mineral Mining and Coal Article 300 in conjunction with Article 105 of Law Number 17 of 2008 concerning Shipping.

The article reads, “Any person who uses a special terminal for public purposes without permission from the minister will be sentenced to a maximum imprisonment of 2 years or a maximum fine of Rp300,000,000 (three hundred million rupiah).”

Then the three ships were also charged with Article 161 of Law Number 3 of 2020 concerning Amendments to Law Number 4 of 2009 concerning Mineral and Coal Mining.

For this article, the statement is, “Every person who accommodates, utilizes, processes and/or refines, develops and/or utilizes, transports, sells minerals and/or coal which does not originate from the holder of an IUP, IUPK, IPR, SIPB or permit as intended in Article 35 paragraph (3) letters c and g, Article 104, or Article 105 is punishable by imprisonment for a maximum of 5 (five) years and a fine of a maximum of Rp100,000,000,000 (one hundred billion rupiah).”
