Self-Aware, Firli Bahuri Withdraws Second Pretrial Lawsuit Against Polda Metro Jaya

Jakarta – Great. Former Corruption Eradication Commission Chairman Firli Bahuri finally realized himself and withdrew his pretrial lawsuit even though it had not yet been tried. This pretrial lawsuit is the second filed by Firli with the reported Director of Special Criminal Investigation (Dirreskrimsus) Polda Metro Jaya, Kombes Pol Ade Safri Simanjuntak.

His first lawsuit with the reported Kapolda Metro Jaya, Irjen Pol Karyoto, failed and was not accepted by the judge.

As is known, Firli is a suspect in a case of alleged extortion or gratification or bribery related to the handling of legal issues at the Ministry of Agriculture during the leadership of Syahrul Yasin Limpo (SYL). Polda Metro Jaya announced him as a suspect on November 22 2023.

Firli opposed this decision and filed a pretrial lawsuit against Kapolda Karyoto as the highest leader of Polda Metro Jaya. But failed to win.

On January 22 2024, Firli again filed a pretrial lawsuit. Only this time the report was Dirreskrimsus Kombes Pol Ade Safri Simanjuntak.

Reported by the SIPP of the South Jakarta District Court (PN Jaksel), Tuesday (23/), the lawsuit has been registered with case number 17/Pid.Pra/2024/PN JKT.SEL. The initial trial will be held Tuesday, January 30 2024.

“Case classification whether the determination of the suspect is valid or not,” wrote SIPP.

In this pretrial lawsuit, Firli appointed constitutional law expert Fahri Bachmid as his attorney. And in his statement, Fahri said that the pre-trial was submitted again because the judge had not decided what was the substance of the previously submitted pre-trial. His party asked the judge to test two existing pieces of evidence.

“So what is asked is to test two pieces of evidence regarding the determination of Mr. Firli as a suspect, which have not yet been substantially assessed by the judge. Second, the confiscation action as a follow-up or as a policy and follow-up actions to the determination of the person concerned as a suspect in the form of confiscation and so on are considered invalid “It’s not procedural,” explained Fahri to journalists.

He continued, Firli believes that the determination of the suspect in the alleged extortion case against SYL was not based on valid evidence. Apart from that, he said the witnesses being examined were irrelevant.

Fahri also said that the South Jakarta District Court judge had not assessed the existing lawsuit in depth until finally the judge’s decision stated that he did not accept, not reject the lawsuit. This is the reason why his party has again filed a pretrial hearing.

“The first decision, the judge had not assessed it in more depth. In the end, the decision was not rejected, but the pre-permit application was not accepted, so the term was NO. If NO had not resolved the main problem, then on that basis we would revise the pre-per’s application by refining what had become “The basis for the pre-trial panel of judges rejecting the first application was like that,” he explained

But that plan is now just a plan. Firli has withdrawn his pretrial lawsuit. The lawsuit was withdrawn even though the initial trial had not yet been held.

“Yes, that’s right,” said Firli’s lawyer, Fahri Bachmid, when asked for confirmation, Friday (26/1).

He said that the withdrawal of the lawsuit was carried out to complete the legal material. He also admitted that he would study further the existing pretrial lawsuit.

“Further enriching aspects of legal material and other substances. Consider the technicality and substance of the application material that we have previously constructed and submitted. There are several important materials and technical strategies that are necessary and important for us to elaborate further, taking into account the legal rules that apply there is,” explained Fachri.

“We will enrich the pretrial material to make it more elementary. So that it will be in accordance with the legal needs and interests of the pretrial application submitted by our client, Mr. Firli Bahuri,” he continued in the statement. Bembo
