Jakarta – Firli Bahuri’s struggle to remove his status as a suspect in a case of extortion and gratification has ended. Hoping that the pre-trial judge’s hammer would abort him, his status was actually further emphasized, even with capital letters: SUSPECT.

The pre-trial hearing of the lawsuit filed by the inactive Chairman of the Corruption Eradication Commission (KPK), Firli Bahuri, regarding his appointment as a suspect with the respondent Kapolda Metro Jaya, Irjen Pol Karyoto, has ended at the South Jakarta District Court (PN), Tuesday, (19/12) afternoon. The trial process closed with the decision of Single Judge Imelda Herawati who rejected all of Firli’s claims.

In his considerations, the judge said that Firli’s pretrial application mixed formal material with material outside the formal aspect.

In his statement, the judge quoted Article 2 paragraph 2 of Supreme Court Regulation Number 4 of 2016 which regulates pretrial matters.

“Considering, that further the provisions of Article 2 paragraph 2 of Supreme Court Regulation Number 4 of 2016, regulate pre-trial examination of applications regarding the invalidity of the determination of a suspect, only assessing formal aspects, namely whether there are or are at least 2 valid pieces of evidence and do not enter into the material of the case, said the judge.

The judge also said that there were arguments from the applicant which could not be used as a basis for a pretrial submission. The reason is that a number of the arguments in question are the main material of the case.

“Considering, that referring to the legal reasons for the pretrial application submitted by the a quo petition, the judge found that there were legal arguments or reasons which could not be used as a basis for filing a pretrial, namely on the grounds of letters A numbers 2, 3, 4, and 5 and letter B because it is the main subject matter of the case,” said the judge.

The judge further stated that the arguments in the petitum also mixed up formal material with material outside the formal aspect. Therefore, the judge firmly believed that the basis of the applicant’s pretrial application was vague or unclear.

“Considering, because of the positive arguments supporting the petition’s petitum as explained previously, it turns out that formal material has been mixed up with material outside the formal aspect,” said the judge.

“So the judge is of the opinion that the basis of the applicant’s pretrial application is vague or unclear or obscur libel,” he continued.

Therefore, the judge considered that the respondent’s exception had legal grounds and should be granted so that the judge considered that the main case also did not need to be considered further.

“Considering that before considering the subject matter of the case, the judge has granted the respondent’s exception, then the subject matter of this case does not need to be considered again. And it is sufficient to state that the applicant’s pre-trial cannot be accepted,” Single Judge Imelda Herawati emphasized in her decision.

As is known, Firli Bahuri was named a suspect in a case of alleged extortion or gratification related to the handling of legal cases at the Ministry of Agriculture (Kementan) when he was led by Syahrul Yasin Limpo (SYL). Feeling unacceptable, Firli applied for a pretrial, but in fact the judge was flatly rejected.

This means that the investigation into Firli as a suspect will certainly continue. In fact, it is not impossible that the process of confinement or detention will be added to prevent them from running away or destroying evidence. Enjoy nightmare, Firli! Bembo
