Jakarta – Calls for Polda Metro Jaya to immediately detain the inactive KPK Chairman, Firli Bahuri, continue to emerge. Most recently, this pressure emerged from Indonesia Police Watch (IPW). IPW’s insistence emerged as a form of support for Polda Metro Jaya to prove that law enforcement does not discriminate.
“We want Polda Metro Jaya to set a real example that law enforcement does not discriminate. Law enforcement is ‘equality before the law’,” said IPW Chairman Sugeng Teguh Santoso in Jakarta, Monday, (4/12).
Teguh further regretted the statement by the Kapolri Jenderal Pol Listyo Sigit Prabowo, who stated that the priority of the case against the suspect, Firli Bahuri, was solving the problem.
“In this case, it appears that Firli Bahuri was not detained. Because of this, IPW regrets the Kapolri statement, even though it is the police’s subjective right,” he said again.
He also said that IPW would intensely urge Polda Metro Jaya to speed up the investigation process. IPW also wants Polda Metro Jaya to quickly ensure that all instructions from research prosecutors from the DKI Jakarta Prosecutor’s Office are immediately fulfilled.
“So that it can be declared P21 so that Firli’s files are immediately submitted to the High Prosecutor’s Office,” said Teguh.
Separately, Chairman of the President of the Non-Governmental Organization People’s Communication Forum for Transparency (NGO FORSI) Berman Nainggolan said, that based on observations so far his party could understand why the Polda Metro had not detained Firli Bahuri.
“We see that Firli Bahuri’s detention is just a matter of time. Wait and see. People just have to be patient,” he said.
He said that one of the possible reasons Firli has not been detained is because Polda Metro Jaya is preparing itself to face Firli’s pretrial lawsuit against the Head of Kapolda Metro Jaya Irjen Pol Karyoto. The pre-trial hearing between Firli and Irjen Pol Karyoto will be held on Monday, December 11 2023 at the South Jakarta District Court (PN).
“Firli doesn’t accept being named a suspect by Polda Metro Jaya. He is suing Irjen Pol Karyoto as the leader of Polda Metro Jaya for pretrial reasons because his appointment as a suspect is invalid and violates his rights as a citizen,” said Berman.
“He hopes that the pre-trial judge will be able to abort his status as a suspect and at the same time embarrass Irjen Pol Karyoto, who was once his subordinate at the KPK,” he added.
Even so, continued Berman, his party is very confident that Firli will lose, and could even lose badly to Irjen Pol Karyoto in pre-trial. The reason, said Berman, was that all of the material in Firli’s pretrial lawsuit was more emotional and egocentric than logical and legal.
“Firli said that his designation as a suspect was invalid because he went straight to investigation without an investigation. He forgot that Article 184 of the Criminal Procedure Code clearly states that the determination of a suspect can be carried out if there are at least 2 pieces of evidence and he has already been examined as a potential suspect or witness. Investigators have fulfilled all these requirements Polda Metro Jaya. So he will definitely lose,” explained the man who also serves as Acting Chair of the PWI Jaya Honorary Council.
Berman is also very confident that Firli Bahuri will be detained by Polda Metro Jaya after the pretrial process is complete. Because legally, the investigator’s subjectivity has many strong and well-founded reasons for putting Firli behind bars.
“Now all parties just have to be patient. The pretrial is over and Irjen Pol Karyoto wins, automatically Firli will be detained. We’ll just prove it later if you don’t believe it,” he said. Bembo
